Mentally Retarded Boy Injured In Fall Awarded $750,000 for Worsening Of Condition

Jose Beltran, a 10-year-old mentally retarded boy, fell off of an unguarded second story landing of an exterior stairway at the defendant's apartment building. The fall happened because the stairway was in a dangerous condition.

Biren Law Group put together a team of experts, including a pediatric neurologist, a neuropsychiatrist, a neuropsychologist, and a vocational rehabilitation expert, to establish that even though this boy was mentally retarded, his condition worsened due to the fall. The experts testified that as a result of the boy's increased diminution in cognitive capabilities and emotional instability, he would have to live in a more controlled environment than would have been anticipated before the accident.

The case was tried and resulted in a $750,000 verdict.
