Can I Still File a Claim if I Am Partially at Fault?

The short answer is yes. California's pure comparative negligence law makes allowances for people who share partial blame for their accident to still recover compensation through an insurance settlement or lawsuit.

Whatever percentage of fault is attributed to you from the accident will be deducted from your initial recovery amount. This means that if you were offered a $50,000 settlement but were found to be 10% at fault for the car crash, you would receive a final recovery of $45,000.

How Long Do I Have to File a Claim?

It's highly recommended that you report your accident to the police and your insurance company within 24 hours if you sustained an injury.
