Jane Doe, a high school student, went to a carnival staged at a local parking lot. One of the portable rides was a swing that rotated 360 degrees.

When the volunteer riders failed to properly connect Ms. Doe, she flew out of the ride, landing on her head. Although the injuries were not as catastrophic as they could have been with this type of accident, the plaintiff sustained a closed head injury which seriously hampered her ability to perform in school or at work.
